Who runs this site

derman.co.za is mine. I run it as an individual, not through a company.

The Electronic Communications and Transactions Act 25 of 2002 asks sites that sell things electronically to publish this. This one sells nothing, so section 43 does not strictly reach it. The details are here anyway, because a site that will not say who runs it is not worth reading.

What this site is

A portfolio. It exists so that somebody deciding whether to hire me can see what I have made and how I went about it. There is nothing to buy, no account to open and no transaction of any kind.

It is not advice. The case studies describe decisions I made on real projects under real constraints, and those constraints were not yours. Reading how I solved something is not the same as my having solved it for you. If you want that, hire me.

The work, and who owns it

The writing, the layout, the code and the photography on this site are mine, and copyright in them stays with me under the Copyright Act 98 of 1978. The work shown was made for clients, and in most cases those clients own it. The client names and logos that appear here belong to them.

What you may do without asking me:

• read it, share it and link to it
• quote a passage with my name on it
• refer to it in a hiring process, or show it to a colleague

What I am asking you not to do:

• present any of this work as your own
• republish a case study in full somewhere else
• use the images in your own material

If you want to do something that is not on the first list, ask me. The answer is usually yes.

Client work

Everything here is either published, launched, or shown with the client’s agreement. Where work has not been announced yet, the case study says so and shows nothing of it. That is a decision, not a gap in the build.

If you are a former client and something here should come down, write to me and it comes down. I will not argue about it.

The scenes are made with AI

Most of the settings on this site, the studios and desks and rooms with work on the walls, were generated with AI and then chosen, cropped and corrected by me. The work on the screens inside them is real work. Where a photograph is a photograph, it is one.

This is in the footer of every page and it is here as well, because a design portfolio that quietly passes generated images off as photography is arguing for a standard it is not keeping.

Accuracy and availability

I keep this site accurate and I keep it up. Neither is a promise. It may be down while I am changing something, a link may rot, and a figure that was right when I wrote it may have moved by the time you read it. If you spot something wrong, tell me and I will fix it.

Nothing here comes with a warranty, and so far as the law allows I am not liable for loss you suffer by relying on it. The Consumer Protection Act 68 of 2008 gives you rights that no wording on this page can take away, and none of this is trying to.

Links to other sites

This site links out, to client sites and to LinkedIn among others. I do not control those and I am not responsible for what is on them. A link is a pointer, not an endorsement of everything at the far end of it.

Using the forms

Use them to write to me. Do not use them to send bulk mail, to test whether they can be used to send bulk mail, or to send anything unlawful. There is a bot check on every page and a limit on how many messages one address can send in an hour, and I will block abuse.

What happens to what you send is set out in the privacy policy.

The law that applies

South African law governs this site and this page, and the South African courts have jurisdiction over any dispute about either. If a court finds part of this page unenforceable, the rest of it stands.

Changes to this page

I change this page when the site changes, and the date at the top moves with it. Using the site after that means the version you are reading is the one that applies.
